欧州議会および理事会規則(EC)No 1107/2009に基づく活性物質S-メトラクロールの承認更新の見送りと、欧州委員会施行規則(EU)No 540/2011の改正

欧州委員会は、理事会指令91/414/EECの付属書Iに含まれていた活性物質S-メトラクロールの認可を更新しなかった。更新手続きにもかかわらず、地下水中の存在や特定の生物に対する毒性など、この物質の潜在的なリスクに関する懸念が残った。その結果、欧州委員会はS-メトラクロールの承認を更新しないことを決定した。

この決定を受けて、実施規則（EU）No 540/2011が改正され、S-メトラクロールが承認された活性物質のリストから削除された。加盟国は2024年4月23日までにS-メトラクロールを含む植物保護製品の認可を取り消すよう指示された。加盟国が認めた猶予期間は2024年7月23日までに終了することが義務づけられた。

同規則はEU官報に掲載されてから20日目に発効した。同規則はすべての加盟国を拘束し、直接適用される。

concerning the non-renewal of the approval of the active substance S-metolachlor, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council, and amending Commission Implementing Regulation (EU) No 540/2011

The European Commission did not renew the approval of the active substance S-metolachlor, which was included in Annex I to Council Directive 91/414/EEC. Despite the renewal process, concerns remained regarding the substance's potential risks, including its presence in groundwater and toxicity to certain organisms. Consequently, the Commission decided not to renew the approval of S-metolachlor.

This decision led to the amendment of Implementing Regulation (EU) No 540/2011 to remove S-metolachlor from the list of approved active substances. Member States were instructed to withdraw authorizations for plant protection products containing S-metolachlor by April 23, 2024. Any grace period granted by Member States was required to expire by July 23, 2024.

The Regulation entered into force on the twentieth day following its publication in the Official Journal of the European Union. It was binding and directly applicable in all Member States.
