The European Commission has adopted a regulation under the REACH framework concerning the chemicals octamethylcyclotetrasiloxane (D4), decamethylcyclopentasiloxane (D5), and dodecamethylcyclohexasiloxane (D6), which pose significant environmental risks due to their very persistent and very bioaccumulative (vPvB) properties. The key points of the regulation are as follows:

Market Restrictions: D4, D5, and D6 are restricted from being placed on the market as substances on their own, as constituents of other substances, or in mixtures if their concentration equals or exceeds 0.1% by weight. This restriction aims to minimize the environmental impact of these substances, which can be significant due to their persistence and bioaccumulative nature.

Deferrals for Specific Uses: The regulation includes specific deferrals to allow time for the transition to alternative substances or technologies. For example:
Leave-on cosmetic products and medical devices: A deferral period of five years.
Dry cleaning solvents: A deferral period of ten years.
Medicinal and veterinary products: A deferral period of seven years.
These deferrals take into account the time required for substitution, qualification, and registration of alternative products.

Exemptions: The regulation provides exemptions for specific uses under controlled conditions. These include:
Industrial uses: Such as monomers in silicone polymer production, intermediates in other silicon substances, and non-metal surface treatment.
Research and development: The use of D4, D5, and D6 as laboratory reagents in controlled conditions is exempted from the restrictions.
Special cases: Specific uses in medical devices for treatment and care of scars and wounds, and professional use in cleaning or restoration of art and antiques.

The regulation was adopted on May 16, 2024, and will enter into force 20 days after its publication in the Official Journal of the European Union. This timing allows stakeholders to prepare for compliance with the new restrictions. The overall goal of these measures is to reduce the emissions of D4, D5, and D6 into the environment, thereby mitigating their harmful environmental impacts.
